Pierse & Fitzgibbon has over forty years experience in dealing with the drafting of wills.   We   realise the importance of planning for future events which making a will allows our clients to do.    We can advise our clients how to leave their assets in a way to minimise or avoid altogether any liability for Inheritance Tax.   We can ensure that proper provision is made for dependent relatives. This may involve the setting up of a Trust.

When somebody dies their assets, which are now called their estate, must be distributed in accordance with the provisions of the Succession Act so that they pass to those legally entitled to them.   Where a deceased person has made a will this process is called Probate.  Where there is no will made the deceased person is said to have died intestate and the process is called Administration.  We can carefully guide our clients through these processes so that the estate is distributed in an efficient and timely manner with all debts and tax liabilities discharged.

Our Wills and Probate Department also deal in the creation of Enduring Powers of Attorney and applications to the High Court to have a person made a Ward of Court.   An Enduring Power of Attorney is a legal device created by a person (called the Donor) when they are in good health.  It allows another specifically appointed person (called an Attorney) to legally act on behalf of the Donor if the Donor becomes incapacitated through illness.    A person is made a Ward of Court when they are no longer mentally capable of dealing with their person or property and have not themselves appointed an Attorney.   Wardship proceedings are instituted to enable the High Court to appoint an Attorney to act on behalf of the person suffering from the mental disability.
